Quechua Tours Travel & Living
The use of the website Travel & Living Peru (the “Website”) is subject to the terms and conditions stated herein. Use of the Website constitutes acceptance by the user (the “Client”) that such use is governed by these Terms and Conditions. Additionally, when using any services provided by Quechua Tours Travel & Living S.R.L. (the “Company”), the Client shall also be subject to any operational policies, guidelines, and procedures applicable to those services, which may be updated from time to time.
1. Bookings and Contract
1.1 Booking Confirmation
To secure a reservation with Quechua Tours Travel & Living, a deposit generally equivalent to 50% of the total program cost is required at the time of booking confirmation. The remaining balance must be paid no later than 30 days prior to the start of the trip unless otherwise specified.
For reservations made within 30 days before departure, full payment will be required immediately.
Reservations made via email, WhatsApp, online platforms, telephone, or through the Website shall constitute full acceptance of these Terms and Conditions.
1.2 Binding Contract
A reservation becomes confirmed and legally binding once Quechua Tours Travel & Living receives the required deposit and the personal information necessary to operate the trip.
1.3 Responsibility of the Lead Passenger
The person making the reservation on behalf of other travelers confirms having the authority to accept these Terms and Conditions on behalf of all members of the group and guarantees that all travelers have been informed and accept these conditions.
1.4 Information Required for Reservations
To process a reservation, the Company may request the following information:
- Full names of travelers (as shown on passports).
- Passport numbers and nationality.
- Travel dates.
- Hotel category and room type.
- Flight information and schedules.
- Number of adults, children, and minors.
- Dietary restrictions or relevant medical conditions.
A representative of Quechua Tours Travel & Living will respond to reservation inquiries within one or two business days whenever possible.
2. Payments
2.1 Payment Methods
Payments may be made through:
- Credit or debit card (Visa, MasterCard, AMEX).
- International bank transfer.
- Authorized payment links.
- Other methods approved by the Company.
All bank charges, transfer commissions, and intermediary fees shall be assumed by the Client.
2.2 Failure to Pay
Failure to complete payments within the established deadlines may result in automatic cancellation of the reservation without liability to Quechua Tours Travel & Living.
3. Machu Picchu Ticket Availability
Machu Picchu entrance tickets are subject exclusively to the official availability established by the Peruvian Ministry of Culture and governmental regulations, which may change without prior notice.
Quechua Tours Travel & Living does not control ticket availability, circuit assignments, entrance schedules, operational restrictions, or modifications implemented by governmental authorities.
In the event of ticket shortages or sold-out dates, the Company may offer alternatives such as:
- Rescheduling the service.
- Modifying circuits or schedules.
- Alternative programs.
- The in-person purchase system in Aguas Calientes.
The Client understands and accepts that the in-person ticket purchase system depends entirely on the official daily availability established by the Peruvian government and requires the physical presence of the passenger with the original passport.
4. Changes Requested by the Client
Any modification requested by the Client must be submitted in writing through email or official communication channels.
Changes may generate penalties, fare differences, or additional operational costs imposed by hotels, airlines, railway companies, the Ministry of Culture, or other suppliers, which shall be assumed by the Client.
Although the Company will make every reasonable effort to accommodate changes and additional requests, availability cannot be guaranteed.
5. Cancellations by the Client
The Client may cancel the reservation at any time by written notification sent to the assigned travel advisor or official Company email.
Cancellation policies vary depending on the services included in each itinerary and the conditions imposed by suppliers such as airlines, hotels, trains, and governmental institutions.
The following conditions apply:
- Machu Picchu entrance tickets, Inca Trail permits, and certain train tickets are generally non-refundable, non-transferable, and non-modifiable once issued.
- Airline tickets may be subject to penalties of up to 100%, depending on fare conditions.
- The Company may apply administrative and operational charges to cover expenses related to itinerary design, reservations, logistical coordination, and financial transaction costs.
Any approved refund shall be subject to the timelines and policies of the corresponding suppliers and payment platforms.
6. No Show and Loss of Services
If the Client fails to arrive on time at meeting points, train stations, airports, terminals, or scheduled activities, the affected services shall be considered a “No Show” and will not be subject to refunds.
The Company shall not be responsible for losses caused by Client delays, incorrect information provided by the passenger, immigration issues, traffic, personal delays, or lack of documentation.
7. Changes or Cancellations by Quechua Tours Travel & Living
Although Quechua Tours Travel & Living will make every reasonable effort to operate services as confirmed, the Client acknowledges that modifications may become necessary due to operational, climatic, governmental, environmental, or logistical circumstances.
The Company reserves the right to:
- Modify itineraries.
- Change hotels or transportation services.
- Alter schedules.
- Replace services with alternatives of similar value.
- Cancel services when necessary for operational or safety reasons.
These modifications may arise from circumstances beyond the reasonable control of the Company, including but not limited to:
- Adverse weather conditions.
- Natural disasters.
- Strikes or protests.
- Road blockades.
- Government restrictions.
- Train or flight schedule changes.
- Pandemics or health emergencies.
- Political instability.
- Force majeure events.
In such cases, Quechua Tours Travel & Living shall not be responsible for indirect losses, missed connections, additional expenses, or liquidity issues resulting from such events.
8. Operational Flexibility
All schedules mentioned in itineraries, tickets, or programs are approximate and may vary due to operational, climatic, railway, airline, governmental, or force majeure conditions.
Quechua Tours Travel & Living will make every reasonable effort to fulfill the confirmed itinerary; however, the Client acknowledges that Peru is a dynamic destination where certain conditions may require immediate operational adjustments.
9. Official Communications
The Client accepts that communications conducted via email, WhatsApp, online booking platforms, or digital messaging constitute official and valid communication channels between both parties.
The Client is responsible for constantly reviewing messages, emails, and notifications related to the trip.
The Company shall not be responsible for inconveniences resulting from failure to read, respond to, or follow communications sent in a timely manner.
10. Travel Documentation and Health Requirements
It is the sole responsibility of the Client to possess:
- A valid passport.
- Applicable visas.
- Vaccination certificates.
- Travel insurance.
- Necessary immigration permits.
The Client is also responsible for verifying all immigration and health requirements applicable to the destinations visited.
11. Travel Insurance
The Company strongly recommends that all passengers obtain international travel insurance covering:
- Cancellations.
- Accidents.
- Medical emergencies.
- Evacuation.
- Baggage loss.
- Other unforeseen events.
The Client acknowledges traveling under his/her own responsibility in the absence of such insurance.
12. Health, Fitness, and Participation
The Client is responsible for ensuring that he/she is physically and medically fit to participate in the contracted tour or activity.
Any medical condition, disability, dietary restriction, or relevant situation must be communicated to the Company in advance.
Quechua Tours Travel & Living reserves the right to deny participation or remove a traveler from any activity if the Company considers that the traveler’s condition or behavior may affect the safety, welfare, or comfort of the group or operation.
13. Local Laws and Conduct
All travelers must respect the laws, regulations, customs, and cultural norms of the countries and destinations visited.
Any illegal, dangerous, abusive, or disruptive behavior may result in immediate removal from the tour without refund.
14. Baggage and Personal Belongings
The Client is responsible for personal belongings throughout the trip.
Quechua Tours Travel & Living shall not be responsible for loss, theft, damage, or forgetting baggage, documents, money, electronic devices, or personal belongings during the services provided.
15. Use of Image
During the operation of services, the Company may take photographs or videos for promotional, advertising, or commercial purposes.
The Client authorizes the use of such material unless expressly communicated otherwise before the beginning of the trip.
16. Claims and Complaints
If the Client experiences any inconvenience during the trip, it must be immediately communicated to the guide, coordinator, or Company representative to allow a reasonable and timely solution.
Failure to notify the Company during operations may reduce or extinguish any later compensation claim.
Any formal complaint must be submitted in writing within 28 days after completion of the trip.
17. Flights and Transportation
Flight, train, and transportation schedules are subject to changes by airlines, railway operators, or transport companies without prior notice.
Quechua Tours Travel & Living shall not be responsible for delays, cancellations, missed connections, or operational modifications caused by third-party transportation providers.
The Company strongly recommends that Clients carefully review all tickets and travel documents immediately upon receipt.
18. Bookings Through Third-Party Platforms
Reservations made through third-party platforms such as Booking.com, Viator, Expedia, or others shall also be subject to the policies, conditions, and procedures established by such platforms.
Quechua Tours Travel & Living does not control refund timelines, payment releases, financial disputes, or administrative decisions made by third-party platforms.
19. Limitation of Liability
Quechua Tours Travel & Living acts as an intermediary between the Client and independent suppliers such as hotels, airlines, railway companies, transport operators, restaurants, tour guides, and governmental institutions.
Although the Company carefully selects its suppliers and seeks to maintain high service standards, it shall not be responsible for:
- Injuries or illnesses.
- Losses or thefts.
- Accidents.
- Delays.
- Force majeure events.
- Negligence of third-party suppliers.
- Additional expenses arising from circumstances beyond its reasonable control.
The Company’s liability is limited exclusively to the proper coordination and delivery of the services expressly confirmed in the final itinerary delivered to the Client.
20. Jurisdiction and Applicable Law
These Terms and Conditions shall be governed by the laws of the Republic of Peru.
Any controversy arising from services provided by Quechua Tours Travel & Living shall be submitted to the jurisdiction of the competent courts of Cusco, Peru.
21. Acceptance of Terms
By making any reservation or payment with Quechua Tours Travel & Living, the Client confirms having read, understood, and fully accepted these Terms and Conditions.
